Insolitus Pty Ltd the company, trading as Jemba, presents its Jemba User Agreement that governs the use of its Services, including mobile applications, website (https://jemba.io/), and associated software and systems. By utilizing these Services, users agree to comply with the terms outlined below:
1. Eligibility: Users must be real human individuals, of legal consent age in their respective countries, or possess the legal authority to create accounts on behalf of other entities.
2. Data Protection and Privacy: Users acknowledge and consent to the collection, use, storage, processing, sharing, and transfer of their information as necessary for the operation of the Services.
3. Content Guidelines: Users are responsible for the content they share, ensuring proper rights and compliance with laws and regulations. Jemba does not tolerate harassment, defamation, threats, hateful content, intellectual property theft, or other illegal activities. Violative Content will be removed.
4. Reporting Violative Content: Users can report Violative Content through the reporting feature within the applications or on the website. Intellectual property infringement can also be reported through the appropriate form.
5. Account Suspension and Deletion: Jemba may temporarily or permanently suspend accounts if Violative Content is shared. A 3-strike policy is applied, with three violations leading to permanent suspension. Certain severe violations will result in immediate and permanent suspension. Accounts may also be temporarily suspended due to abnormal activity or deleted if inactive for over 2 years. Users can delete their accounts at any time.
6. License to Use the Services: During usage, Jemba grants users a personal, non-assignable, non-exclusive, royalty-free, and worldwide license to use the software provided as part of the Services. This license terminates upon ceasing to use the Services.
7. Limitation of Liability: Users acknowledge that Jemba, its affiliates, officers, directors, employees, and licensors' liability is limited to the extent permitted by their country of residence.
8. Applicable Law and Jurisdiction: State of New South Wales, Australia.
9. Updates and Unenforceable Provisions: Jemba may update the User Agreement, notifying users approximately 7 days before the changes take effect. If users continue to use the Services, they agree to the updated terms. If any provision is found unenforceable, the remaining terms remain applicable.
